David E. Lister

David E. Lister, a founding partner is now of counsel to the firm and assists, as needed, at trial and in appellate aspects of workers' compensation and disability discrimination defense. These include 132a allegations, OSHA defense, ADA, FEHA, wrongful termination and PERS retirement matters. He is recognized as one of the leading attorneys in California in the area of workers' compensation discrimination.

Mr. Lister is a frequent lecturer and has spoken at seminars sponsored by the State Bar of California, Los Angeles Bar Association, California Self-Insurers Association and Workers' Compensation Defense Attorneys Association on discrimination issues and workers' compensation issues as well.

Prior to 1988, Mr. Lister had been a partner in the Los Angeles law firm of Kegel, Tobin, Hamrick & Truce where he served as the lead appellate counsel for the firm, specializing in workers' compensation defense. Prior to that, he was an insurance defense attorney with Lawler, Felix & Hall in Los Angeles where he acquired a great deal of his appellate experience.

He received his B.A. degree in Political Science in 1964 from the University of Iowa and his Juris Doctor from Stanford Law School in 1967. Upon graduation, he served from 1967 to 1971 as a lieutenant in the U.S. Navy, including a one year tour of duty in Vietnam .

Mr. Lister was admitted to the State Bar of California in 1972. Throughout his career, he has tried hundreds of workers' compensation cases and numerous civil cases, has participated in a great number of arbitration proceedings. He has appeared before the California Supreme Court and Court of Appeal on multiple occasions and is admitted to practice before the United States Supreme Court. He is a member of the panel of arbitrators of the WCAB and, since his retirement. now devotes considerably more time to alternative dispute resolution.
